Welcome to Curbside Clubhouse ("Company," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of our website, booking platform, and mobile golf simulator event services (the "Services"). By booking or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.
1. Our Services
Curbside Clubhouse provides mobile golf simulator rental and event services, including delivery, setup, on-site hosting, and teardown, for events such as:
Birthday parties
Bachelor / bachelorette parties
Weddings
Corporate events
Private gatherings
Package inclusions vary by tier (The Front Nine, The Back Nine, The Full Round, or custom arrangements) as described on our website at time of booking.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to book our Services. The person booking the event is responsible for the conduct of their guests.
3. Booking & Deposits
Bookings are confirmed upon receipt of a signed agreement and required deposit, unless otherwise stated.
Deposit amounts, remaining balance due dates, and accepted payment methods will be provided at the time of booking.
We reserve the right to decline or cancel a booking that violates these Terms or poses a safety concern.
4. Cancellations & Rescheduling
Cancellations must be submitted in writing.
Weather: Because our Services involve outdoor setup, severe weather (lightning, high winds, heavy rain) may require rescheduling for guest and equipment safety. We will work with you to find an alternative date.
5. Site Requirements
You are responsible for ensuring the event location has adequate space, a level surface, and access for delivery and setup as communicated by our team prior to the event. Additional fees may apply for difficult access, extended travel distance outside our standard service area, or setup requirements outside the agreed scope.
6. Service Area
We currently serve events throughout Los Angeles & Orange County. Events outside this area may be accommodated at our discretion and may incur additional travel fees.
7. Equipment Use & Guest Conduct
Our equipment is operated under the supervision of a dedicated Curbside Clubhouse host at all times.
Guests must follow the host's instructions when using the simulator, clubs, and related equipment.
You agree not to allow guests to use equipment while intoxicated to a degree that creates a safety risk, or to misuse, damage, or remove any equipment from the event location.
You may be held financially responsible for damage to equipment caused by guest misconduct or negligence beyond normal wear and tear.
8. Assumption of Risk & Liability
Golf simulator activities involve inherent risks, including the use of golf clubs and other equipment. By booking or participating in a Curbside Clubhouse event, you and your guests acknowledge and assume these risks.
To the fullest extent permitted by law, Curbside Clubhouse, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to personal injury, property damage, or loss of enjoyment, except to the extent caused by our gross negligence or willful misconduct.
9. Photos, Video & Marketing
By booking our Services, you grant Curbside Clubhouse permission to photograph or record general event activity and setup for use in marketing, our website gallery, and social media, as described in our Privacy Policy. If you would prefer not to appear in published content, notify us in advance of your event.
10. Intellectual Property
All website content, branding, logos, photography, and materials made available by Curbside Clubhouse are our exclusive property or that of our licensors and may not be copied, reproduced, or used without prior written permission.
11. Service Availability
While we strive to deliver every booked event as scheduled, service may be affected by circumstances beyond our control (weather, vehicle issues, equipment failure, third-party delays). In such cases, we will make reasonable efforts to reschedule or provide an appropriate remedy.
12. Indemnification
You agree to indemnify, defend, and hold harmless Curbside Clubhouse, its owners, employees, and contractors from any claims, liabilities, damages, or expenses arising from your or your guests' use of our Services, violation of these Terms, or violation of any applicable law.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the appropriate state or federal courts located in California.
14. Changes to These Terms
We may revise these Terms at any time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our Services after changes become effective constitutes acceptance of the updated Terms.
